Amador County Code Chapter 15.04.060 Building and Construction has been revised to provide for an exemption from the Grading Permit requirement for certain grading activity (Ordinance No. 1721). This Exempt Grading Activity is to be documented and tracked without a permit being issued. The following is a summary of Exempted Grading requirements:

i. All Excavations of less than 50 cubic yards shall not require permit or notification of Amador County.

ii. Excavation and or placement of material shall not exceed 500 cubic yards. Larger grading projects may not be split or separated into smaller projects for the purpose of exempting an otherwise non-exempt grading project;

iii. Exempt grading activities may begin only after April 15 and shall be completed prior to October 15; activities may continue as exempt beyond October 15th if proof and verification that a Notice of Intent has been filed with the Regional Water Quality Control Board; or, a grading permit has been obtained with the filing of the requisite Erosion Control Plan;

iv. No structure that requires a building permit may be located on any area graded pursuant to this section;

v. Cut and fill slopes shall not exceed 2:1(Horizontal : Vertical);

vi. Cut and fill depths shall not exceed 4 feet in depth as measured between a point on the original grade and the same point measured in the final graded condition;

vii. Grading shall not disturb or redirect any existing drainage patterns;

viii. Disturbance of more than 1 acre shall require a Notice of Intent to be filed with the Regional Water Quality Control Board;

ix. Top of cuts or toe of fills shall be at least 4 feet from all property lines and beyond drainage;

x. Grading of driveways or access roads shall comply with the provisions of Chapter 15.30, and Owner shall certify that any driveway or access road will be constructed in compliance with Chapter 15.30. In the event a deviation from the provisions of Chapter 15.30 will be necessary, a deviation request, pursuant to Section 15.30.170, shall be filed and approved prior to any grading;

xi. All fills shall be compacted to 90% relative compaction;

xii. Materials such as wood debris, roots, stumps and other deleterious and unsuitable material shall not be buried within the fill; and

xiii. Erosion control measures shall be in place in disturbed areas prior to October 15.

Property owners whose activity meets the conditions of the exemption will need to fill out an Exempted Grading Acknowledgement Form. The owner will certify that his/her grading activity will comply with all of the conditions listed and supply a sketch and description of the proposed work.  Upon completion of the form, the owner will submit it to Public Works along with the $85.00 fee.

In the event that 1) any otherwise exempt grading is conducted without prior payment of the applicable fee and submission of a properly executed Grading Acknowledgement form, or 2) any grading performed pursuant to this Section fails to comply with the provisions set forth above, such grading shall not be exempt and the Owner shall be required to obtain a grading permit, meeting all standards and paying all fees then in effect.

The fee was adopted by Resolution No. 12-025 by the Board of Supervisors.
